Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you (“you”, “your”, the “User”) and Cravings IT Pvt Ltd, a company incorporated under the Companies Act, 2013 and having its registered office in Pune, Maharashtra, India, which operates the KhetiGPT service (referred to in these Terms as “Cravings IT”, “KhetiGPT”, “we”, “us”, “our”). By accessing or using the Service (defined below) you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

These Terms are an electronic record under the Information Technology Act, 2000 and the rules thereunder. No physical, electronic or digital signature is required for these Terms to be binding.

1. The Service

KhetiGPT is an AI-assisted advisory product for Indian farmers, accessible primarily through the WhatsApp Business Platform and via the website at www.khetigpt.com(collectively, the “Service”). The Service may include weather, market price (mandi), crop-care, soil test, government scheme and similar agricultural information in multiple Indian languages.

2. Eligibility

  • You must be at least 18 years old.
  • You must have the legal capacity to enter into a binding contract under Indian law.
  • You must not be barred from receiving services under applicable law (including not appearing on any sanctions list).
  • The Service is intended primarily for users physically located in India.

3. Account & communications

We do not require a traditional account. By submitting our sign-up form or by messaging our WhatsApp business number you authorise us to:

  • Send you a welcome and onboarding message in your chosen language.
  • Send you the answers and follow-up messages necessary to fulfil your queries.
  • Send occasional service messages (e.g. policy updates, planned downtime).

You can stop service communications at any time by replying STOP on WhatsApp or writing to privacy@khetigpt.com.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose, or to cause harm to any person, property, crop, livestock or ecosystem.
  • Attempt to reverse-engineer, scrape, decompile, or otherwise extract the source code or training data of the Service or its sub-processors.
  • Probe, scan, or test the vulnerability of the Service or breach any security or authentication measures.
  • Submit content that is defamatory, obscene, threatening, hateful, misleading, infringing of intellectual-property rights, or otherwise unlawful under Indian law.
  • Use automated means (bots, scripts) to access the Service except for legitimate accessibility tools.
  • Impersonate another person or transmit malware, viruses, or any malicious code.
  • Use the Service to generate or distribute spam, unsolicited commercial communications, or political propaganda.
  • Resell, sublicense, or commercialise the responses generated by the Service without our prior written consent.

We may suspend or terminate your access at any time and without notice if we reasonably believe you have violated these Terms.

5. User content & licence

You retain ownership of all content you submit to the Service (messages, photos, voice notes — collectively “User Content”). You grant KhetiGPT a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, process, and display User Content solely to:

  • operate, maintain, and deliver the Service to you;
  • generate aggregated, de-identified analytics and statistics;
  • comply with legal obligations, including lawful requests from authorities;
  • improve the Service through manual review of a small sample of messages (with PII stripped) for quality assurance and safety tuning.

You represent and warrant that you have all rights necessary to grant this licence and that your User Content does not infringe any third party's rights.

6. Intellectual property

The Service, including the KhetiGPT name, the wheat/leaf logo, the website, the design system, the prompts, the orchestration code, and all other materials provided by us (collectively, “KhetiGPT IP”) is the exclusive property of KhetiGPT and is protected by Indian and international copyright, trademark, and other intellectual-property laws.

  • We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or internal business use.
  • You may not copy, modify, distribute, sell, lease, or create derivative works of any part of the KhetiGPT IP without our prior written consent.
  • All trademarks, service marks, trade names, and logos of third parties referenced in the Service are the property of their respective owners.

7. AI-generated content — important disclaimer

Responses produced by the Service are generated by artificial intelligence systems and by integrations with third-party data sources. They may be incomplete, inaccurate, or out-of-date. The Service is provided for informational and educational purposes only and is not a substitute for:

  • advice from a qualified agronomist, soil scientist, or extension officer;
  • veterinary advice for livestock health;
  • professional medical advice for human health;
  • legal, financial, tax, insurance, or investment advice (including regarding government schemes);
  • official guidance from competent government authorities.

You are solely responsible for any decision you take based on the Service's output. Always verify critical information (e.g. pesticide dosage, scheme eligibility, market prices) with a qualified professional or the official source before acting on it.

8. Third-party services & data sources

The Service depends on third-party platforms and data sources, including but not limited to the WhatsApp Business Platform, OpenAI, OpenWeather, the Government of India open-data platform (data.gov.in / Agmarknet), Sentry, Google Analytics, and our cloud hosting provider. KhetiGPT is not responsible for the availability, accuracy, or behaviour of these third-party services, and your use of them may be subject to their own terms and privacy policies.

9. Service availability & modifications

  • The Service is provided on a best-effort basis. We do not warrant uninterrupted or error-free operation.
  • We may add, change, suspend, or discontinue any feature at any time without prior notice.
  • We may impose usage limits (rate limits, message-size caps, file type / size restrictions) to ensure fair use and platform stability.

10. Fees

The Service is currently offered free of charge to individual farmers. We reserve the right to introduce paid tiers, premium features, or partner-specific pricing in the future. Any such change will be notified in advance and will not retroactively apply to past usage.

11. Privacy

Our collection, use and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Warranties & disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. KHETIGPT DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KHETIGPT, ITS DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY:

  • indirect, incidental, special, consequential, or punitive damages;
  • loss of profit, revenue, crop yield, livestock, business opportunity, goodwill, or data;
  • damages arising from your reliance on any advisory, price, weather, scheme, or other information generated by the Service.

OUR AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) INR 1,000 OR (b) THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW (E.G. FRAUD OR GROSS NEGLIGENCE).

14. Indemnity

You agree to defend, indemnify, and hold harmless KhetiGPT and its officers, directors, employees, agents, partners, and licensors from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • your access to or use of the Service;
  • your User Content;
  • your breach of these Terms or of applicable law;
  • your infringement of any third-party right.

15. Suspension & termination

  • We may suspend or terminate your access immediately, without notice, if we reasonably believe you have breached these Terms, violated applicable law, or pose a security or abuse risk.
  • You may stop using the Service at any time by replying STOP on WhatsApp or by writing to privacy@khetigpt.com to request deletion of your account.
  • Sections that by their nature should survive termination (including 6, 7, 12, 13, 14, 17 and 18) will survive.

16. Force majeure

We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, government action, pandemics, internet or telecommunications failures, failures of third-party platforms (including WhatsApp), power outages, strikes, war, terrorism, or civil unrest.

17. Governing law & dispute resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles.

Any dispute, controversy, or claim arising out of or in connection with these Terms shall first be attempted to be resolved amicably through good-faith negotiation between the parties within 30 days of written notice. If not resolved, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by KhetiGPT. The seat and venue of arbitration shall be Pune, Maharashtra. Proceedings shall be conducted in English. The award shall be final and binding on the parties.

Subject to the above, the courts at Pune, Maharashtra shall have exclusive jurisdiction over any matter that may be brought before a court.

18. Grievance Officer

In accordance with the Information Technology Act, 2000 and the rules thereunder, the name and contact of the Grievance Officer is:

  • Response time: complaints acknowledged within 48 hours and resolved within 15 days.

19. Miscellaneous

  • Entire agreement. These Terms together with the Privacy Policy constitute the entire agreement between you and KhetiGPT regarding the Service.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely, including to a successor entity in a merger, acquisition, or sale of assets.
  • Notices. We may give notices to you via WhatsApp, email, or by posting on the website. You may give notices to us at legal@khetigpt.com.
  • Language. These Terms are published in English. Translations may be provided in regional languages for convenience; in case of conflict, the English version shall prevail.

20. Changes

We may update these Terms from time to time. Material changes will be notified at least 7 days before they take effect via WhatsApp and / or a banner on the website. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
